Information (Clarification) Text on the Protection and Processing of Personal Data

In accordance with the provisions of the Personal Data Protection Law No. 6698 (“KVKK”), all of your information that determines or makes your identity identifiable, including your special personal data, is processed as Personal Data by ALGA MÜMESSİLLİK VE FOREIGN TRADE INC. (ALGA for short) in its capacity as Data Controller, within the scope below.

The concept of “processing your personal data” is a legal concept, and in Law No. 6698, this concept refers to any operation performed on personal data, such as obtaining, recording, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data.

Your personal data that you share with our company as a subscriber, customer, supplier, consumer, physical or online visitor, business partner or employee (including apprentices and interns) may be processed in accordance with the KVKK, in connection with and proportionate to our activity and service objectives, and may be transferred to third parties at home and abroad, stored, used and classified for profiling or other commercial purposes related to our business.

As ALGA, we attach the utmost importance to the security of your personal data, and we take the highest possible security measures to protect your privacy during the legal collection, storage, processing and, if necessary, sharing of your personal data in all our products and services we offer you.

Our purpose in publishing this information/clarification text is to inform you in the clearest way possible, in line with your satisfaction, about the ways your personal data is collected, the purposes of processing, the legal reasons for processing and your legal rights.

Below you will find important information and concepts regarding the protection and processing of personal data, and it is aimed to fully enlighten you with these concepts.



a) Who is the Data Controller?

In accordance with the Personal Data Protection Law No. 6698 (Law No. 6698), our Company is the data controller, ALGA MÜMESSİLLİK VE FOREIGN TRADE ANONYMOUS COMPANY. Your personal data will be collected and processed by the data controller, ALGA MÜMESSİLLİK VE FOREIGN TRADE ANONYMOUS COMPANY (ALGA for short), within the scope described below.

 

b) For What Purposes Your Personal Data is/will be Processed

Your personal data will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the purposes of fulfilling your contracts, making necessary evaluations for the service offered, ensuring compliance with domestic and international legislation, especially tax legislation and Social Security Institution legislation, complying with risk monitoring and information obligations, fulfilling information sharing, reporting, and information obligations stipulated by the authorities, fulfilling information and document retention obligations arising from legislation, preventing fraud, ensuring security, carrying out the planning and statistical activities needed by our company, determining and implementing our company's commercial and business strategies, carrying out our finance, communication, market research and purchasing operations, maintaining in-house system and application management operations, managing our legal processes and carrying out social responsibility projects, and providing you with better and more reliable service without interruption.

 

In addition to the above, your personal data may be processed for the purposes of developing and offering all kinds of products and services tailored to you, communicating with you regarding the products and services you have purchased/will purchase, and, if you have given your permission, for use in promotions, product/service offers, marketing and campaign activities, developing services and products suitable for you, conducting customer satisfaction studies, conducting existing or new product studies of our company and market research and target customer group identification, and using data for statistical purposes, etc.

 

Within the framework of contracts made with third parties or legal entities that have a business relationship with our company or joint activities, your personal data may be processed for the purpose of fulfilling our company's legal and commercial obligations arising from the contracts, establishing and protecting rights, commercial and legal evaluation processes, legal and commercial risk analyses and carrying out financial affairs.

 

Personal data of the candidate employees contacted through our company's human resources activities may be processed by our company for a maximum of 1 year for the purpose of re-evaluation within the framework of another position in case the recruitment, evaluation, communication, placement and other human resources activities and job application is rejected for any reason.
 

c) To Whom and For What Purposes Can Processed Personal Data Be Transferred?

Your personal data may be transferred to authorities such as the Revenue Administration of the Ministry of Finance of the Republic of Turkey, the Social Security Institution, limited to the achievement of the above-mentioned purposes and the fulfillment of the obligations imposed by the legislation, within the limits of the relevant legislation, to legally authorized public institutions such as ministries and judicial authorities, to support service organizations and other contracted organizations from which our Company receives services that are complementary or an extension of its activities, to consultants and organizations with which it cooperates where permitted by legislation, to financial institutions, audit or independent audit companies, and to banks, in accordance with the personal data processing conditions and purposes specified in Article 8 of Law No. 6698 regarding the transfer of personal data and Article 9 regarding the transfer of personal data abroad.

 

ç) Method and Legal Reason for Collecting Personal Data

Your personal data is collected through channels through which our company or institutions, organizations and persons authorized to represent our company communicate or may communicate with you in the future, such as our company's website, mobile or digital applications, social media, customer interviews, SMS messages, written/digital applications made to our company and other websites, direct sales teams, support service organizations, and to the extent and within the limits permitted by the relevant legislation and the contracts made, and from time to time by accessing the databases of various institutions and organizations, with your consent when legally required.

Your personal data collected through these methods may be processed and transferred for the purposes specified in this Information, within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

 

d) According to the regulation in Article 11 of Law No. 6698, as a Personal Data Owner, your rights listed in Article 11 are as follows;

To learn whether your personal data has been processed,
To request information about it if your personal data has been processed,
To learn the purpose of processing your personal data and whether it is being used in accordance with its intended purpose,
To know the third parties to whom your personal data has been transferred, whether domestically or internationally,
To request correction of your personal data if it is incomplete or inaccurate, and to request notification of the action taken in this context to the third parties to whom your personal data has been transferred,
To request the deletion or destruction of your personal data if the reasons requiring processing no longer exist, despite the data being processed in accordance with the provisions of Law No. 6698 and other relevant laws, and to request notification of the action taken in this context to the third parties to whom your personal data has been transferred,
To object if you believe that a detrimental result has been produced by the analysis of your processed data exclusively through automated systems,
To request compensation for your losses if you suffer damages due to the unlawful processing of your personal data.

If you submit your requests regarding your rights to our company using the methods specified below, our company will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on its nature.

However, if the transaction incurs an additional cost, our company will collect the fee specified in the tariff determined by the Personal Data Protection Board. In this context, in accordance with Article 13, paragraph 1 of Law No. 6698, you can submit your request to exercise your above-mentioned rights to our company in writing or by other methods determined by the Personal Data Protection Board. In this context, the channels and procedures through which you can submit your written application to our company within the scope of Article 11 of Law No. 6698 are explained below. To exercise your rights specified above, after filling out and signing the relevant person/data owner application/request form, a sample of which can be found at www.alga.com.tr, you must submit this application form or your original signed petition to exercise your rights;
